RealViz - Terms of Service Agreement

This Terms of Service Agreement (“Agreement”) is entered into between RealViz (“Company”) and the Client (“Client”). By accepting an online quote or proposal provided by RealViz, the Client agrees to the following terms and conditions:

1. Scope of Services

RealViz agrees to provide the following services as outlined in the project quote:

•Installation and removal of time-lapse cameras, drones, 360-degree cameras, and related equipment.

•Production of time-lapse videos, 3D visuals, drone footage, and post-production editing.

•Cloud storage, remote monitoring via CloudX Dashboard, and content hosting as specified in the quote.

Any additional services requested outside of the agreed scope will require an amendment to the quote and may incur additional charges.

2. Project Timeline

•RealViz will adhere to the estimated project timeline provided in the quote.

•Delays caused by weather, site inaccessibility, or third-party vendors may impact delivery schedules. RealViz will communicate any changes promptly.

3. Client Responsibilities

To ensure smooth delivery of services, the Client agrees to:

•Provide safe access to the project site for installation, maintenance, and removal of equipment.

•Maintain communication and approval for deliverables such as video edits and visual content.

•Obtain any necessary site permissions, permits, or third-party approvals required for filming or equipment installation.

4. Fees and Payments

•Fees are outlined in the project quote provided to the Client.

•A deposit (percentage specified in the quote) is due before the project start date, with the remaining balance payable upon project completion.

•Late payments may incur interest charges at a rate of 1.5% per month on overdue balances.

5. Equipment and Liability

•RealViz retains ownership of all rented equipment, including time-lapse cameras, drones, and accessories.

•The Client is responsible for ensuring the safety of RealViz equipment while on-site. Any loss, damage, or theft caused by negligence may result in repair/replacement fees.

6. Deliverables and Ownership

•RealViz retains ownership of all raw footage and source files.

•Upon full payment, the Client is granted usage rights for edited time-lapse videos and visuals for promotional purposes.

•Deliverables are provided in the format specified in the quote (e.g., custom landing page, Vimeo uploads).

7. Cancellations and Refunds

•If the Client cancels a project after acceptance, fees for any work already performed or costs incurred will remain payable.

•Deposits are non-refundable unless otherwise agreed upon in writing.

8. Limitation of Liability

RealViz will not be held liable for:

•Project delays caused by unforeseen circumstances (weather, site issues, etc.).

•Loss of footage due to equipment malfunction or acts of nature.

•Damages exceeding the total cost of the project outlined in the accepted quote.

9. Confidentiality

RealViz agrees to keep all Client information and project details confidential unless given written consent for promotional use.

10. Governing Law

This Agreement is governed by and construed in accordance with the laws of the State of Georgia.

11. Acceptance of Terms

By accepting the online quote, the Client acknowledges that they have read, understood, and agreed to the above Terms of Service.
